Deputy Calkins responded in reference to a domestic battery. V-1 advised his girlfriend’s adult daughter, S-1, struck him in the face during a previous argument. It was determined that V-1 was unable to provide specific details of the incident and appeared to be under the influence of alcohol. Contact was made with W-1 and S-1, who both advised no physical violence occurred. They claimed the source of the verbal argument involved S-1 taking V-1’s telephone for the purpose of locating evidence of his infidelity. They also alleged that V-1 made statements that he would contact 911 and claim a battery by S-1. Deputy Calkins observed no sign of injury to V-1 and could not establish probable cause that a battery occurred. V-1 was insistent on filing charges; therefore an affidavit was filed with the State Attorney for review.
