Deputy Richardson responded to an accident scene in the 1800 block of Tatum Blvd, New Smyrna, FL to assist Deputy Cowger with a crashed abandoned vehicle. Deputy Richardson observed the front of the vehicle to have sustained significant damage. Deputy Richardson noticed both front airbags were fully deployed and the windshield was severely cracked on driver and passengers sides. Deputy Richardson noted it was very possible the driver of the vehicle may have sustained injuries to their head and/or face area. Deputies needed to establish if the owner of the vehicle knew where the vehicle was, and if the driver was injured and possibly needed medical attention. The Vehicle was registered to D-1 who was later determined to have crashed the vehicle and left the scene. Deputy Richardson located D-1 at her residence several blocks away from the crash site. Deputy Richardson asked D-1 if she would voluntarily return to the scene. D-1 agreed and returned. Deputy Richardson noted D-1 to be under the influence of alcohol and/or narcotics due to slowed movements and speech. Deputy Richardson returned to the crash to await FHP. Once at the scene D-1 became agitated in the back seat of the patrol vehicle. D-1 began banging her head on the cage of his vehicle and yelling. Deputy Richardson opened the rear door where D-1 was sitting to see what was happening. D-1 continued to yell at Deputy Richardson and then spit into his face which struck him on the front of his face. Deputy Richardson grabbed D-1 by her left arm and called for Deputy Cowger to assist getting D-1 out of his backseat. D-1 was pulling away from Deputy Richardson trying to break free of his grip. Deputy Cowger assisted Deputy Richardson by grabbing D-1’s other arm. Upon being removed from Deputy Richardson’s back seat she was escorted to the ground and safely taken into custody. D-1 was subsequently charged with Battery LEO and resisting W/O violence. D-1 was transported to VCBJ without further incident. FHP completed their accident investigation and towed D-1’s vehicle.
