  1. Section 107 of the Copyright Act 1976 makes allowance is for fair use of materials that have a copyright. Purposes such as criticism, comment, news reporting, teaching, scholarship, and research are allowed. Fair use is a use permitted by copyright statute that might otherwise be infringing.

    I am not a lawyer. This is not legal advice. You should seek out a lawyer who IS FAMILIAR with 1st Amendment and copyright issues for advice. Simply claiming Fair Use under 17 U.S. Code § 107 – Limitations on exclusive rights: Fair use will not stop your HOA from filing suit and seeking damages if they are determined to shut you up. It would only serve as your defense when you take the time and effort to respond to the suit in legal proceedings.
